1.1 Lovemore Sports Ltd (“Lovemore Sports”, “we”, “us” or “our”) is committed to protecting and respecting the privacy of the individuals whose personal data we process. This Privacy Policy explains how we collect, use, disclose and safeguard personal data, and describes the rights available to individuals under the UK General Data Protection Regulation (the “UK GDPR”) and the Data Protection Act 2018.
1.2 For the purposes of the UK GDPR, the data controller is Lovemore Sports Ltd, a company registered in England and Wales with its registered office at 50 Grosvenor Hill Mayfair London W1K 3PZ (Company No.: 12872042). We determine the purposes and means of the processing of personal data described in this Policy.
1.3 Lovemore Sports Ltd has not appointed a statutory Data Protection Officer because it is not required to do so under Article 37 of the UK GDPR. Responsibility for data protection rests with the Directors of the Company. Data protection enquiries and requests may be directed to us at info@lovemoresports.com.
2. Scope and Definitions
2.1 This Policy applies to personal data we process in the course of our business as a sports management and commercial advisory firm, including data relating to athlete clients and their representatives, brand and commercial partners, website visitors and enquirers, and job and internship applicants. It applies to information collected through our website, in correspondence, and in the ordinary course of providing our Services, including media production through Lovemore Studios.
2.2 In this Policy, the following terms have the meanings given to them in the UK GDPR. “Personal data” means any information relating to an identified or identifiable natural person. “Processing” means any operation performed on personal data, whether or not by automated means, including collection, storage, use, disclosure and erasure. “Controller” means the person that determines the purposes and means of processing. “Processor” means a person that processes personal data on behalf of a controller. “Special category data” means personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, data concerning health, or data concerning a person’s sex life or sexual orientation.
3. Categories of Personal Data We Collect
3.1 The categories of personal data we collect vary according to the individual’s relationship with us. The descriptions below are indicative and not exhaustive.
Athlete clients and their representatives
3.2 We may process identity and contact details (including name, date of birth, nationality and contact information); financial data (including bank details, tax information and fee arrangements); contractual data relating to representation, sponsorship and endorsement arrangements; image, likeness and publicity data used in commercial and media contexts; and performance, career and reputational information relevant to the commercial management of an athlete’s career.
Brand and commercial partners
3.3 We may process business contact details of individuals acting on behalf of partner organisations, together with information relating to commercial terms, negotiations, deliverables and the performance of partnership arrangements.
Website visitors and enquirers
3.4 We may process contact form data, the content of correspondence, and technical information collected through cookies and similar technologies, as described in our Cookie Policy.
Job and internship applicants
3.5 We may process the information contained in applications and curricula vitae, references, right-to-work documentation, and correspondence relating to recruitment and selection.
4. How We Collect Personal Data
4.1 We collect personal data directly from individuals, for example when a Client enters into an engagement, when a partner negotiates a commercial arrangement, when a visitor submits an enquiry through our website, or when an applicant applies for a role.
4.2 We also collect personal data from third parties and other sources, including an individual’s appointed representatives, referees nominated by applicants, service providers acting on our behalf, and publicly available sources such as official sporting records, media coverage and professional networking platforms, where relevant to our legitimate business activities.
4.3 Where we obtain personal data from a source other than the individual concerned, we will, where required by Articles 13 and 14 of the UK GDPR, provide that individual with information about our processing within a reasonable period, unless an exemption applies. We take care to ensure that data obtained from third-party or public sources is relevant, proportionate and used only for purposes compatible with those for which it was originally made available.
4.4 We may also generate personal data in the ordinary course of our business, for example records of communications, notes of meetings and negotiations, and information created in connection with the commercial management of a Client’s career or the delivery of a media production.
5. Purposes and Lawful Bases for Processing
5.1 We process personal data only where we have a lawful basis to do so under Article 6 of the UK GDPR. The principal bases on which we rely are set out below.
5.2 Performance of a contract. We process personal data where necessary to enter into and perform our engagement agreements with Clients and our commercial arrangements with partners, including negotiating, administering and fulfilling those arrangements.
5.3 Legitimate interests. We process personal data where necessary for our legitimate interests or those of a third party, provided those interests are not overridden by the rights and freedoms of the individual. Our legitimate interests include developing and managing client and partner relationships, promoting our Services and the athletes and productions we represent, ensuring the security of our systems, and administering our business. Where we rely on legitimate interests, we carry out a balancing assessment to ensure the individual’s interests are appropriately considered.
5.4 Consent. We rely on consent where it is required, for example for certain electronic marketing communications and for the use of non-essential cookies. Where we rely on consent, it may be withdrawn at any time without affecting the lawfulness of processing carried out before withdrawal.
5.5 Legal obligation. We process personal data where necessary to comply with our legal and regulatory obligations, including obligations relating to taxation, employment, financial record-keeping and the prevention of fraud and money laundering.
5.6 Special category data. Where we process special category data, we do so only where an additional condition under Article 9 of the UK GDPR applies, such as the individual’s explicit consent or the establishment, exercise or defence of legal claims. Such data is processed with heightened safeguards and only where strictly necessary.
6. Marketing Communications
6.1 We may send marketing communications about our Services, athletes, partnerships and productions where we are permitted to do so under the UK GDPR and the Privacy and Electronic Communications Regulations 2003 (PECR). We will obtain your consent where required, and we will always provide a straightforward means of opting out of marketing communications, which you may exercise at any time by contacting us or by using the unsubscribe facility included in our communications.
6.2 Where we rely on the “soft opt-in” available under PECR to send marketing to existing business contacts about similar services, we do so only where the recipient did not object when their details were collected and is given the opportunity to object in every subsequent communication. We maintain records of marketing preferences and honour opt-out requests promptly. We do not sell personal data to third parties for their own marketing purposes.
7. Data Sharing, Recipients and International Transfers
7.1 We may share personal data with third parties where necessary for the purposes described in this Policy. Recipients may include professional advisers (such as legal, accounting and insurance advisers); brand and commercial partners in connection with agreed arrangements; service providers and processors who support our operations (including information technology, hosting, media production and administrative services); and regulators, law enforcement and other authorities where required by law.
7.2 Where we engage processors, we do so under written contracts that require them to process personal data only on our instructions and to implement appropriate technical and organisational measures.
7.3 Some recipients may be located outside the United Kingdom. Where personal data is transferred internationally, we ensure that an appropriate safeguard under Chapter V of the UK GDPR is in place, such as a transfer made to a country subject to UK adequacy regulations, the International Data Transfer Agreement (IDTA) or the UK Addendum to the EU Standard Contractual Clauses, together with any supplementary measures required. [Placeholder: confirm the specific transfer mechanisms and recipient countries applicable to the firm’s operations.]
8. Data Retention
8.1 We retain personal data only for as long as is necessary to fulfil the purposes for which it was collected, including to satisfy any legal, regulatory, accounting or reporting requirements, and to establish, exercise or defend legal claims.
8.2 The criteria we use to determine retention periods include the nature and sensitivity of the data, the duration of our relationship with the individual, applicable limitation periods, and relevant legal and regulatory obligations. [Placeholder: insert or cross-refer to the firm’s data retention schedule.] When personal data is no longer required, we will securely delete or anonymise it.
9. Security
9.1 We implement appropriate technical and organisational measures designed to protect personal data against unauthorised or unlawful processing and against accidental loss, destruction or damage. These measures include access controls, secure storage, staff confidentiality obligations and the careful selection of service providers. While we take security seriously, no method of transmission or storage can be guaranteed to be entirely secure, and we cannot warrant the absolute security of personal data.
9.2 We have procedures in place to detect, report and investigate personal data breaches. Where a breach is likely to result in a risk to the rights and freedoms of individuals, we will notify the Information Commissioner’s Office without undue delay and, where feasible, within 72 hours of becoming aware of it. Where a breach is likely to result in a high risk to individuals, we will also inform those affected without undue delay, in accordance with Articles 33 and 34 of the UK GDPR.
10. Your Rights
10.1 Subject to the conditions and exemptions set out in the UK GDPR, you have a number of rights in relation to your personal data. These include the right of access to your personal data; the right to rectification of inaccurate or incomplete data; the right to erasure in certain circumstances; the right to restrict processing; the right to data portability; the right to object to processing carried out on the basis of legitimate interests or for direct marketing; and rights in relation to automated decision-making and profiling. We do not carry out solely automated decision-making that produces legal or similarly significant effects.
10.2 To exercise any of these rights, please contact us using the details set out in clause 12. We will respond without undue delay and in any event within one month of receipt of your request, although this period may be extended by up to two further months where necessary, taking into account the complexity and number of requests, in which case we will inform you of the extension and the reasons for it. We may need to verify your identity before responding.
11. Complaints to the Information Commissioner’s Office
11.1 If you have any concerns about the way in which we process your personal data, we would encourage you to contact us in the first instance so that we may seek to resolve the matter. You also have the right to lodge a complaint with the Information Commissioner’s Office (ICO), the supervisory authority for data protection in the United Kingdom. The ICO may be contacted at Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF, by telephone on 0303 123 1113, or via its website at ico.org.uk.
12. Cookies, Children’s Data, Changes and Contact
12.1 Our website uses cookies and similar technologies. Full details of the cookies we use, the purposes for which they are used, and how you can manage your preferences, are set out in our Cookie Policy, which should be read alongside this Privacy Policy.
12.2 Our website and Services are directed at professional and adult audiences and are not intended for children. We do not knowingly collect personal data relating to children. If we become aware that we have inadvertently collected such data without an appropriate lawful basis, we will take steps to delete it.
12.3 We may update this Policy from time to time to reflect changes in law, regulation or our practices. The current version is the version published on our website, identified by the “Last Updated” date shown on the title page. We encourage you to review this Policy periodically.
